Client Service Agreement.
Effective Date:  ·  PTO Travel Agency LLC operating under Waiter's Travel

This Client Service Agreement ("Agreement") is entered into between PTO Travel Agency LLC ("Agency," "we," "us," or "our"), operating under host agency Waiter's Travel, and the undersigned client ("Client," "you," or "your"). By submitting an inquiry, paying a service fee, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

Section 1

Scope of Services

PTO Travel Agency LLC is an independent travel agency operating under host agency Waiter's Travel. We provide travel planning, booking coordination, and concierge-style itinerary management services at three (3) service tiers:

  • Essentials Tier — $400 service fee. Covers core travel planning and booking coordination for straightforward itineraries.
  • Signature Tier — $600 service fee. Covers enhanced planning, personalized itinerary curation, and dedicated coordination.
  • Opulence Tier — $1,600 annual service fee. Covers full-concierge, white-glove travel planning for complex, multi-destination, or luxury experiences.

Service fees are charged for planning, research, and coordination time — not for the cost of travel itself. Travel costs (flights, hotels, tours, etc.) are paid directly to suppliers or invoiced separately.

Section 2

Service Fees & Payment

Section 2 — The Operational Planning Fee Disclaimer. PTO functions strictly as a high-end retainment boutique. The professional asset management and planning fees — specifically established at $400 for The Essentials, $600 for The Signature, and $1,600 for The Opulence — are charged completely upfront. These fees compensate our office for the industrial-grade precision, destination research, and administrative labor required to build your custom itinerary outline. Consequently, these retainment fees are 100% non-refundable upon payment. They cover the immediate allocation of our planning assets and are entirely separate from the actual cost of your flight, villa, resort, or transfer bookings. While our office applies total focus to vetting and secure curation, all live market pricing and itinerary availability remain subject to change by third-party luxury suppliers until your formal booking execution is completed.

2.1 Service fees are non-refundable regardless of whether travel is completed, cancelled, or modified. By paying a service fee, you are compensating the Agency for time, expertise, and resources expended on your behalf.

2.2 Payment of the service fee is required before the Agency commences detailed planning, booking, or supplier negotiations.

2.3 Service fees do not include travel costs such as flights, hotel accommodations, tours, transportation, travel insurance, visas, passports, resort fees, gratuities, or any other supplier charges.

2.4 The Agency reserves the right to adjust service fees for scope changes, added destinations, or materially increased complexity after initial engagement. Any adjustments will be communicated and agreed upon in writing prior to additional charges.

2.5 Invoices for travel costs are due per supplier and booking deadlines communicated to you during planning. Failure to pay supplier invoices by deadlines may result in cancellation of bookings without refund.

Section 3

Client Responsibilities

You agree to:

  • Provide accurate, complete, and timely information including full legal names, dates of birth, passport details, dietary restrictions, mobility needs, and other relevant personal information.
  • Communicate preferences, budget constraints, and travel goals clearly and promptly.
  • Review all booking confirmations, itineraries, and travel documents within 24 hours of receipt and report any discrepancies immediately.
  • Obtain and maintain all required travel documents including valid passports, visas, and entry requirements. The Agency is not responsible for denied entry, missed travel, or losses resulting from inadequate documentation.
  • Secure adequate travel insurance. The Agency strongly recommends Clients purchase comprehensive travel insurance including trip cancellation, medical, and evacuation coverage.
  • Respond to communications from the Agency within a reasonable timeframe. Delays in Client communication may affect booking availability and pricing.
Section 4

Agency Role & Limitations

4.1 The Agency acts as an independent intermediary between Clients and travel suppliers. The Agency does not own, operate, or control any travel supplier.

4.2 The Agency does not guarantee supplier performance, service quality, or availability. All bookings are subject to the terms and conditions of the respective supplier.

4.3 Prices quoted are subject to change until confirmed and paid. The Agency is not responsible for price increases occurring after a quote is issued but before payment is received.

4.4 The Agency will advocate on your behalf in the event of supplier issues; however, we cannot guarantee outcomes and are not liable for supplier failures, insolvencies, or acts outside our control.

Section 5

Force Majeure

The Agency shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government-imposed travel restrictions, war, terrorism, strikes, civil unrest, or supplier insolvencies. In such events, the Agency will use commercially reasonable efforts to assist in rebooking or recovering funds from suppliers, though outcomes are not guaranteed and service fees remain non-refundable.

Section 6

Limitation of Liability

6.1 To the maximum extent permitted by applicable law, PTO Travel Agency LLC, its members, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from travel services arranged on your behalf, including: personal injury, property damage, travel delays, cancellations, missed connections, supplier defaults, or acts of third parties.

6.2 The Agency's total liability to any Client shall not exceed the total service fees paid to the Agency by that Client for the specific booking in dispute.

6.3 Nothing in this Agreement limits liability for fraud, gross negligence, or willful misconduct.

Section 7

Disputes & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Pennsylvania, without regard to conflict of law principles. Any dispute arising from this Agreement that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in Center Valley, Pennsylvania. Each party shall bear its own attorneys' fees and costs unless otherwise determined by the arbitrator.

Section 8

Entire Agreement & Amendments

This Agreement, together with any booking confirmation, invoice, and applicable policies incorporated herein, constitutes the entire agreement between the parties. The Agency reserves the right to update this Agreement at any time. The version in effect at the time of booking governs that booking.

Section 1

Service Fees — Non-Refundable

All service fees paid to PTO Travel Agency LLC are strictly non-refundable. Service fees represent compensation for planning, research, coordination, supplier negotiations, and professional time invested on your behalf — regardless of whether travel is completed.

No exceptions: This applies to all package tiers (The Essentials $400, The Signature $600, The Opulence $1,600) including medical emergencies, personal emergencies, changes in financial circumstances, or Force Majeure Events.
Section 2

Travel Booking Cancellations

Cancellations of travel bookings are subject to each individual supplier's cancellation policies, which may include fully non-refundable bookings, partial refunds, future travel credits, or supplier cancellation fees. The Agency will communicate each supplier's specific cancellation terms in writing at the time of booking.

Strongly recommended: PTO Travel Agency LLC strongly recommends all Clients purchase comprehensive travel insurance at or before the time of booking. Declining travel insurance is done at your sole risk.
Section 4

No-Show Policy

Failure to appear for a confirmed booking ("No-Show") without prior cancellation will result in total forfeiture of the booking amount per supplier policies. No refunds will be issued by the Agency in connection with a No-Show.

Section 5

Agency-Initiated Modifications

In the rare event that the Agency is unable to fulfill a confirmed booking due to reasons within our control, we will use reasonable efforts to provide a comparable alternative or facilitate a refund of travel costs from the supplier. The Agency's liability is limited to service fees paid.

  • Cookie data: session cookies and analytics cookies. You may disable cookies in your browser settings; however, some site features may not function properly.

How We Use Your Information

  • Process inquiries and deliver travel planning services.
  • Make reservations, purchase tickets, and coordinate travel arrangements with suppliers on your behalf.
  • Communicate with you regarding bookings, itineraries, confirmations, and travel updates.
  • Send marketing communications (with your consent; you may opt out at any time).
  • Comply with legal obligations and enforce our agreements.
  • Improve our services, website, and client experience.
Section 3

How We Share Your Information

We do not sell your personal information. We may share your information with:

  • Travel suppliers (airlines, hotels, cruise lines, tour operators) solely to the extent necessary to complete your bookings.
  • Host agency Waiter's Travel, for operational and compliance purposes.
  • Third-party service providers (CRM platforms, payment processors, email marketing tools) who assist us in operating our business, subject to confidentiality obligations.
  • Law enforcement or regulatory authorities when required by applicable law or legal process.
Section 4

Data Retention

We retain your personal information for as long as necessary to provide services, maintain business records, and comply with legal obligations. Booking-related records are typically retained for a minimum of seven (7) years for accounting and legal purposes.

Section 5

Your Rights

Depending on your jurisdiction, you may have the right to access, correct, or request deletion of your personal information. You may opt out of marketing communications at any time by clicking "Unsubscribe" in any email or contacting us at admin@ptotravelagency.com.

California residents: Additional rights under the California Consumer Privacy Act (CCPA) apply, including the right to know what personal information is collected and the right to non-discrimination for exercising privacy rights.
Section 6

Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information. However, no data transmission or storage system is 100% secure. We cannot guarantee absolute security and disclaim liability for breaches not caused by our gross negligence or willful misconduct.

Section 7

Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, contact us immediately.

Travel Liability Waiver & Release.
Effective Date:  ·  Each adult traveler must sign separately for group bookings

This Travel Liability Waiver and Release ("Waiver") is entered into voluntarily by the undersigned Client in favor of PTO Travel Agency LLC, its members, employees, agents, host agency Waiter's Travel, and their respective successors and assigns (collectively, "Released Parties").

Assumption of Risk

Inherent Risks of Travel

Travel involves inherent risks that cannot be fully controlled by the Agency. These include, without limitation:

  • Transportation delays, cancellations, rerouting, or accidents.
  • Natural disasters, weather events, and acts of God.
  • Political instability, civil unrest, or terrorism at destinations.
  • Medical emergencies, illness, or injury while traveling.
  • Loss or theft of luggage, documents, or personal property.
  • Supplier errors, defaults, or insolvency.
  • Denied boarding or entry due to documentation issues, health screenings, or government restrictions.

By engaging PTO Travel Agency LLC's services, I acknowledge and accept these risks as inherent to the travel experience.

Release

Release of Liability

In consideration of PTO Travel Agency LLC's services, I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising out of or related to my travel, including those caused by the negligence of the Released Parties, to the fullest extent permitted by applicable law.

Acknowledgment

Health & Destination Risk Acknowledgment

I confirm that I am aware of the health requirements and advisories for my destination(s) and that I am physically and medically fit to travel. I acknowledge that I have independently researched travel advisories as published by the U.S. Department of State (travel.state.gov) and the CDC (cdc.gov). I accept responsibility for my decision to travel to my chosen destination(s) regardless of any advisories in effect.

Booking Eligibility
Age Validation.
Applies to the primary profile holder on every PTO itinerary
Section 1

Intellectual Parameters & Age Validation

To preserve the seamless execution of our luxury transit networks and elite resort allocations, the primary profile holder initializing a PTO itinerary must be 25 years of age or older at the time of booking. Traveling companions and family units of all ages are fully accommodated under the primary booker's authorized umbrella. This boundary ensures total compliance with international luxury fleet insurance frameworks and private estate check-in mandates.

Minimum booking age — 25. The primary profile holder must be 25 or older at the time of booking. Companions and family of all ages travel under that primary booker's authorized umbrella.
